GMAX Trackstars Mobile App — Athletics Training Academy

Please read these Terms of Service (“Terms”) carefully before using the GMAX Trackstars mobile application. By creating an account or using the App, you agree to be bound by these Terms. If you are a parent or guardian registering on behalf of a child under 13, you are agreeing to these Terms on that child’s behalf.
These Terms form a legally binding agreement between you and GMAX Trackstars (Charity No. 1138783), 22a, 24 Sydenham Rd, London SE26 5QW.
1. About GMAX Trackstars
GMAX Trackstars is a Sport England-supported, award-winning registered charity dedicated to changing young lives through sport and developing the next generation of Olympic and Paralympic athletes. The App is a digital tool that supports our athletic training programme.
2. Eligibility & Account Registration

Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorised access to your account.
One person may not hold multiple accounts. GMAX Trackstars reserves the right to merge or terminate duplicate accounts.
Third-Party Login
You may register using a third-party login provider (e.g., Google or Apple). By doing so, you authorise us to access basic profile information from that provider. Your use of third-party login services is also subject to their respective terms and privacy policies.
3. App Features & Acceptable Use

You agree to use the App only for lawful purposes and in a manner consistent with GMAX Trackstars’ values and mission. You must not:
- Provide false, misleading, or inaccurate information at registration or at any time
- Use the App to harass, bully, threaten, or harm any other user
- Attempt to access any data or account that does not belong to you
- Use the App for any commercial purpose without our written consent
- Upload or transmit content that is offensive, illegal, or infringes the rights of others
- Attempt to reverse-engineer, decompile, or tamper with the App
GMAX Trackstars reserves the right to suspend or terminate any account that violates these Terms without prior notice.
4. Safeguarding & Child Protection
- Coach messaging is provided for coaching and training purposes only and must remain professional and appropriate at all times
- Any safeguarding concern identified through the App will be reported to the appropriate authorities in line with our Safeguarding Policy
- Under-13 accounts are managed by a parent or guardian, who is responsible for monitoring their child’s use of the App
- GMAX Trackstars staff and coaches are bound by our safeguarding policies and are DBS-checked where required

5. Intellectual Property
All content within the App — including text, graphics, logos, training plans, and software — is the property of GMAX Trackstars or its licensors and is protected by UK and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes in connection with your participation in the GMAX Trackstars programme. You may not copy, reproduce, distribute, or create derivative works from any App content without our prior written consent.
You retain ownership of any personal data and performance information you submit to the App. By submitting content (such as a profile picture), you grant GMAX Trackstars a limited licence to display that content within the App for the purpose of providing the service.
6. Payments & Refunds
All current fees for GMAX Trackstars membership and training sessions are handled in person and are not processed through the App. Please refer to our in-person registration process for current pricing and payment terms.
In-person refund requests are handled at the discretion of GMAX Trackstars management. Please contact us at [email protected] for any payment queries.
Future versions of the App may introduce in-app payments. These Terms will be updated accordingly and you will be required to agree to updated payment terms before making any in-app purchases.
7. Disclaimers & Limitation of Liability
No Medical or Training Advice
The App provides tools to record and track athletic activity in connection with coached sessions delivered by GMAX Trackstars. The App does not provide medical advice, personal training advice, or nutritional guidance. Always consult a qualified healthcare professional before starting any new fitness programme, particularly if you have a pre-existing medical condition.
Service Availability
We aim to keep the App available at all times but do not guarantee uninterrupted or error-free access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavour to provide advance notice of planned downtime where possible.
Limitation of Liability
To the fullest extent permitted by law, GMAX Trackstars shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of the App. Our total liability to you for any claim arising from these Terms shall not exceed £100 or the amount you have paid us in the preceding 12 months, whichever is greater.
8. Termination
You may delete your account at any time by contacting us at [email protected]. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.
GMAX Trackstars may suspend or terminate your account if:
- You breach these Terms or our Safeguarding Policy
- We have reason to believe fraudulent or harmful activity has occurred
- Your account has been inactive for an extended period (see Privacy Policy for retention details)
Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — shall continue to apply.
9. Changes to the App & These Terms
We may update these Terms from time to time to reflect changes in the App, our services, or applicable law. We will notify you of material changes via the App at least 14 days before they take effect. Continued use of the App after changes come into force constitutes your acceptance of the updated Terms.
We may also update, add, or remove App features at any time and will communicate significant changes in advance where possible.
10. Governing Law & Disputes
These Terms are governed by the laws of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
